We like to reward our customers with something a little more wonderful when they add Mercury Broadband to their energy plan. Lots of words, we know! But here's everything you need to know about the offer. Grab a cup of tea and have a read!

If you signed up to Mercury Broadband before 30 November 2022 these terms apply.

If you signed up to Mercury Broadband on or after 30 November 2022 these terms apply.

Your Mercury Broadband plan will be tied to the type of electricity or electricity and gas (Dual Fuel) plan that you currently have or are signing up to. 

 

If you are adding broadband and are on one of the following plans:

  1. you are signing up to a new fixed term residential electricity or Dual Fuel plan or CHCH Great Rates 2022 plan with Mercury; or
  2. you have an existing fixed term residential electricity or Dual Fuel plan with Mercury with 90 days or more remaining on its term; or
  3. you have an existing CHCH Great Rates 2022 plan with 90 days or more remaining on your fixed price period,

you will be on a fixed term broadband plan and the following terms will apply:

Eligibility and key details

  1. This fixed term broadband offer ("Offer") is available to:
    1. New Mercury residential customers who:
      1. join Mercury for electricity or Dual Fuel on a 1 or 2 year fixed term plan or on a CHCH Great Rates 2022 plan, and
      2. are accepted as a Mercury customer in accordance with Mercury's General Residential Terms and Conditions, including a satisfactory credit check, or
    1. Existing Mercury residential customers as follows:
      1. customers who are on an existing Mercury residential electricity or Dual Fuel fixed term plan, and have 90 days or more remaining on that fixed term plan; or
      2. customers who are on an existing Mercury CHCH Great Rates 2022 plan, and have 90 days or more remaining on their fixed price period for that plan.
  2. This Offer is available to be accepted from 9 June 2022.
  3. If accepted by you (as the customer) and by us (in accordance with Mercury’s Phone and Internet Terms and Conditions for Residential Customers), the terms of this Offer apply from the date you accept this Offer and continue for the duration of your existing fixed term electricity or Dual Fuel plan, or the duration of the fixed price period of your CHCH Great Rates 2022 plan, the ("Offer Period"). To be crystal clear, this means you are signing up to a fixed term plan for Mercury Broadband that:
    1. For existing customers, has the same term as your existing electricity or Dual Fuel fixed term plan or the fixed price period of your CHCH Great Rates 2022 plan; or
    2. For joining customers, has the same term as the electricity or Dual Fuel fixed term plan, or the fixed price period of the CHCH Great Rates 2022 plan, you're joining Mercury on, with the fixed term for broadband starting from the date you are connected for electricity.
  4. In addition to the eligibility criteria at 1., this Offer will only be available:
    1. if you will be receiving Mercury Broadband at the same property that your electricity or Dual Fuel fixed term plan or your qualifying CHCH Great Rates 2022 plan relates to;
    2. if you already have fibre broadband installed at that property;
    3. if you are not on, or joining on, any of the following plans: Even Pay, Average Spot, or debt repayment instalment plans; and
    4. so long as you continue to have your residential electricity or Dual Fuel fixed term plan, or your qualifying CHCH Great Rates 2022 plan, at the same property that you receive your Mercury Broadband for the duration of the Offer Period.
  5. An early termination fee may apply if you leave Mercury Broadband before the end of the Offer Period (see Ending your fixed term plan below).

Broadband plan details

  1. You will need to take up this Offer by:
    1. selecting one of Mercury's unlimited naked fibre broadband plans to apply during the Offer Period, either:
      1. Unlimited Fibre at $79 per month; or
      2. Unlimited Fibre Ultra at $89 per month; and
    1. selecting one of Mercury's routers (unless you want to bring your own router, see "Router details" below).
  2. Please note that our plan speeds are based off the national peak time average speeds from the latest Commerce Commission 'Measuring Broadband NZ' report. Actual speeds you experience may be higher or lower, as speeds are affected by many different factors such as your router, number of users accessing broadband at your property and your geographic location.
  3. Please note this Offer does not include a landline and Mercury does not offer static IP addresses. 

Router details

  1. As part of the Offer, you can select one of the following routers :
    1. Single Router
    2. Ultimate WiFi router – 2 pack
    3. Ultimate WiFi router – 3 pack
    4. Everyday router
  2. This Offer includes the cost of your router, unless you select an Ultimate WiFi router (3 pack), which will incur a $44.00 charge. If selected, this charge will appear on your first broadband bill.
  3. You will be charged a $15.00 delivery fee where you select a Mercury router. This will appear on your first broadband bill. We are unable to deliver Mercury routers to PO boxes.
  4. From time to time, our routers may become unavailable from our supplier. If that happens and you've already selected your router, we will let you know of this change and use reasonable endeavours to replace the router with a similar router. If this situation arises, we will contact you to discuss alternate options. If you choose not to accept the replacement router, you can cancel this Offer without incurring an early termination fee.
  5. If you wish to bring your own router, you will not incur any router or delivery charges. However, it is your responsibility to ensure your router is compatible with Mercury's network and our support team may not be able to help with any issues you have with it. The type of router you use may impact your broadband speed, connection, quality and performance. To find out if your router will be compatible with Mercury's network, check to see if your router is listed as being compatible on our website and if it isn't listed, call us on 0800 10 18 10.

Changing your fibre speed

  1. You can switch between our Unlimited Fibre and Unlimited Fibre Ultra plans no more than once in each of your broadband billing cycles without incurring an early termination fee through My Account or by contacting us on 0800 10 18 10.
  2. We will schedule the change as soon as possible once we receive your request, and the change can take up to 10 working days to implement. We will let you know once it is complete.
  3. You will be charged at your new plan's rates from the date the plan change is completed ("Plan Change Date"). Depending on your broadband billing cycle, you may have already paid at your previous plan's rates for a number of days after the Plan Change Date. If that's the case, then you will see a pro-rata bill credit on your next bill for the Plan Change Date and any days after that Date you were charged at your previous plan's rates, and a pro-rata charge for the Plan Change Date and any days after at the new plan's rates. For example, if your billing cycle is 5 September to 4 October, and your plan change happens on 1 October, you will receive a pro-rata bill credit for 1 to 4 October (inclusive) at your previous plan's rate, and a new pro-rata charge for 1 to 4 October (inclusive) at your new plan's rates.
  4. Other than the change to the fibre speed and pricing that results from a switch between the Unlimited Fibre and Unlimited Fibre Ultra plans, your existing terms and conditions will remain in full force and effect.
Ending your fixed term broadband plan
  1. If you change your mind before you're connected to Mercury Broadband, we will do our best to cancel your Offer before you incur any costs. If you have accepted this Offer as a result of an uninvited direct sale (where you have not invited us (or our partners) to call you), you can cancel within 5 working days of receiving confirmation of the fixed term broadband plan you have entered into. Where you cancel within 5 working days, we will refund you any charges that you may have paid in relation to this Offer.
  2. Otherwise, you can cancel your fixed term broadband plan at any time by giving us at least 30 days' prior notice, unless we agree to a shorter notice period. You'll be responsible for any charges until your disconnection date. 
  3. To compensate Mercury for its reasonable losses, an early termination fee of $143 (inclusive of GST, if any) if you select an Ultimate WiFi router, $89 (inclusive of GST, if any) if you select a Single Router or $94 (inclusive of GST, if any) if you select an Everyday router will apply if:
    1. you cancel your Mercury Broadband; or
    2. you are no longer eligible to receive the Offer before the end of the Offer Period (including if you cancel your fixed term electricity or Dual Fuel plan, or your CHCH Great Rates 2022 plan before the end of the fixed price period, (or if it is otherwise terminated)). 
  4. This early termination fee does not apply if:
    1. You have accepted your fixed term broadband plan as a result of an uninvited direct sale (where you have not invited us (or our partners) to call you) and you cancel within 5 working days of receiving confirmation of the fixed term broadband plan you have entered into; or
    2. You have chosen to bring your own router rather than selecting one of Mercury's routers as part of the Offer.
  5. At the end of the Offer Period, you will revert to the then applicable standard Mercury prices for Mercury Broadband (available on our website), unless Mercury offers you, and you accept, a new fixed term plan for Mercury Broadband before the end of the Offer Period.

Moving

  1. If you want to move property during the Offer Period, please contact us at least 10 business days before you move. You should be able to take your Broadband fixed term plan with you so long as your move is to a property that already has Fibre Broadband available and you also take your Mercury residential electricity or Dual Fuel fixed term plan or CHCH Great Rates 2022 plan with you. If we are unable to transfer your Mercury Broadband to your new address, your broadband will be disconnected on the future date you select for disconnection and you will not be charged a broadband early termination fee.

Energy services

  1. Your current residential electricity or Dual Fuel fixed term plan or CHCH Great Rates 2022 plan and its terms and conditions continue to apply separately for your energy services, including any applicable early termination fees.
  2. Any Prompt Payment Discount that you are eligible for under your current residential electricity or Dual Fuel plan or CHCH Great Rates 2022 plan will not apply to any bill payments you make for your broadband plan, including if you receive your bill online and pay your bill by direct credit. However, you must continue to pay your entire bill (including any broadband bill payments) in full and on time in order to receive your Prompt Payment Discount(s).

Other legal stuff

  1. We strongly recommend double checking your agreement with your previous broadband provider to make sure you're aware of any early termination fees or other charges that will apply when you end your agreement with them, as Mercury won't be responsible for those charges.
  2. Your use of broadband is subject to Mercury's Improper Use policy – available here.
  3. The prices referred to in this Offer are inclusive of GST but this plan does not include any Mercury Fees. Any subsequent change to the NZ Government GST rate and Mercury Service Fees within the Offer Period will apply.
  4. The Offer is not transferable, exchangeable or redeemable for cash.
  5. Mercury's standard Privacy Policy and Mercury’s Phone and Internet Terms and Conditions for Residential Customers apply.

 

If you are adding broadband and you are:

  1.  signing up to a new open term residential electricity or electricity and gas (Dual Fuel) plan with Mercury (other than a CHCH Great Rates 2022 plan with 90 days or more remaining in the fixed price period); or
  2.  on an existing open term residential electricity or Dual Fuel plan with Mercury (other than a CHCH Great Rates 2022 plan with 90 days or more remaining in the fixed price period),
  3. on an existing residential Mercury electricity or Dual Fuel fixed term plan with less than 90 days remaining on your plan; or
  4. on an existing residential Mercury CHCH Great Rates 2022 plan with less than 90 days remaining in the fixed price period,

  4. By accepting this Offer, you will be signing up to an open term plan for Mercury Broadband.
  5. In addition to the eligibility criteria at 1, this Offer will only be available:
    1. if you will be receiving Mercury Broadband at the same property that your electricity or Dual Fuel plan, or your CHCH Great Rates 2022 plan, relates to;
    2. if you already have fibre broadband installed at that property;
    3. if you are not on, or joining on, any of the following plans: Even Pay, Average Spot, or debt repayment instalment plans; and
    4. so long as you continue to have your residential electricity or Dual Fuel plan, or your CHCH Great Rates 2022 plan, at the same property that you receive your Mercury Broadband.

b.       you are no longer eligible to receive the Offer before the end of the Offer Period (including if you cancel your fixed term electricity or Dual Fuel plan (or if it is otherwise terminated)).

a.       You have accepted your fixed term plan as a result of an uninvited direct sale (where you have not invited us (or our partners) to call you) and you cancel within 5 working days of receiving confirmation of the fixed term plan you have entered into; or

b.       You have chosen to bring your own router rather than selecting one of Mercury's routers as part of the Offer.

22.   At the end of the Offer Period, you will revert to the then applicable standard Mercury prices for Mercury Broadband (available on our website), unless Mercury offers you, and you accept, a new fixed term plan for Mercury Broadband before the end of the Offer Period.

Moving

23.   If you want to move property during the Offer Period, please contact us at least 10 business days before you move.  You should be able to take your Broadband fixed term plan with you so long as your move is to a property that already has Fibre Broadband available and you also take your Mercury residential electricity or Dual Fuel fixed term plan with you.  If we are unable to transfer your Mercury Broadband to your new address, your broadband will be disconnected on the future date you select for disconnection and you will not be charged a broadband early termination fee.

Energy services

24.   Your current residential electricity or Dual Fuel fixed term plan and its terms and conditions continue to apply separately for your energy services, including any applicable early termination fees.

25.   Any Prompt Payment Discount that you are eligible for under your current residential electricity or Dual Fuel plan will not apply to any bill payments you make for your broadband plan, including if you receive your bill online and pay your bill by direct credit.  However, you must continue to pay your entire bill (including any broadband bill payments) in full and on time in order to receive your Prompt Payment Discount(s).

Other legal stuff

26.   We strongly recommend double checking your agreement with your previous broadband provider to make sure you're aware of any early termination fees or other charges that will apply when you end your agreement with them, as Mercury won't be responsible for those charges.

27.   Your use of broadband is subject to Mercury's Improper Use policy – available here.

28.   The prices referred to in this Offer are inclusive of GST but this plan does not include any Mercury Service Fees.  Any subsequent change to the NZ Government GST rate and Mercury Service Fees within the Offer Period will apply.

29.   The Offer is not transferable, exchangeable or redeemable for cash.

Eligibility and key details

1.       This open term broadband offer ("Offer") is available to:

a.       Mercury residential electricity or Dual Fuel customers who are on an existing Mercury residential electricity or Dual Fuel open term plan or are on an existing Mercury residential electricity or Dual Fuel fixed term plan with less than 90 days remaining on that fixed term plan; or

b.       New Mercury residential customers who join Mercury for electricity or Dual Fuel on an open term plan and are accepted as a Mercury customer in accordance with Mercury’s standard energy terms and conditions, including a satisfactory credit check.

2.       This Offer is available to be accepted from 9 June 2022.

3.       If accepted by you (as the customer) and by us (in accordance with Mercury's General Residential Terms and Conditions, including a satisfactory credit check.), the terms of this Offer apply from the date you accept this Offer and continue until terminated in accordance with clauses 19 or 20 below.

4.       By accepting this Offer, you will be signing up to an open term plan for Mercury Broadband.

5.       This Offer will only be available:

a.       if you will be receiving Mercury Broadband at the same property that your electricity or Dual Fuel plan relates to;

b.       if you already have fibre broadband installed at that property;

c.       if you are not on, or joining on, any of the following plans: Even Pay, Average Spot, or debt repayment instalment plans; and

d.       so long as you continue to have your residential electricity or Dual Fuel plan at the same property that you receive your Mercury Broadband.

Broadband plan details

6.       You will need to take up this Offer by:

a.       selecting one of Mercury’s unlimited naked fibre broadband plans, either:

                                                   i.      Unlimited Fibre at $79 per month; or

                                                 ii.      Unlimited Fibre Ultra at $89 per month; and

b.       selecting one of Mercury’s routers (unless you want to bring your own router, see "Router details" below).

7.       Please note that our plan speeds are based off the national peak time average speeds from the latest Commerce Commission 'Measuring Broadband NZ' report.  Actual speeds you experience may be higher or lower, as speeds are affected by many different factors such as your router, number of users accessing broadband at your property and your geographic location.

8.       Please note this Offer does not include a landline and Mercury does not offer static IP addresses.

Router details

9.       Unless you bring your own router, you will need to purchase one of Mercury’s routers to access Mercury Broadband:

a.       Single Router ($120)

b.       Ultimate WiFi router - 2 pack ($220)

c.       Ultimate WiFi router – 3 pack ($299)

d.       Everyday router ($120)

10.   The charge for the router you select will appear on your first broadband bill.

11.   You will be charged a $15.00 delivery fee where you select a Mercury router.  This will appear on your first broadband bill.  We are unable to deliver Mercury routers to PO boxes.

12.   From time to time, our routers may become unavailable from our supplier. If that happens and you've already selected your router, we will let you know of this change and use reasonable endeavours to replace the router with a similar router. If this situation arises, we will contact you to discuss alternate options. 

13.   If you wish to bring your own router, you will not incur any router or delivery charges.  However, it is your responsibility to ensure your router is compatible with Mercury's network and our support team may not be able to help with any issues you have with it.  The type of router you use may impact your broadband speed, connection, quality and performance.  To find out if your router will be compatible with Mercury's network, check to see if your router is listed as being compatible on our website and if it isn't listed, call us on 0800 10 18 10. 

Changing your fibre speed

14.   You can switch between our Unlimited Fibre and Unlimited Fibre Ultra plans no more than once in each of your broadband billing cycles through My Account or by contacting us on 0800 10 18 10.

15.   We will schedule the change as soon as possible once we receive your request, and the change can take up to 10 working days to implement.We will let you know once it is complete.

16.   You will be charged at your new plan's rates from the date the plan change is completed ("Plan Change Date").  Depending on your broadband billing cycle, you may have already paid at your previous plan's rates for days after the Plan Change Date.  If that's the case, then you will see a pro-rata bill credit on your next bill for the Plan Change Date and any days after you were charged at your previous plan's rates, and a pro-rata charge for the Plan Change Date and any days after at the new plan's rates.For example, if your billing cycle is 5 September to 4 October, and your plan change happens on 1 October, you will receive a pro-rata bill credit for 1-4 October (inclusive) at your previous plan's rate, and a new pro-rata charge for 1-4 October (inclusive) at your new plan's rates.

17.   Other than the change to the fibre speed and pricing that results from a switch between the Unlimited Fibre and Unlimited Fibre Ultra plans, your existing terms and conditions will remain in full force and effect. 

Ending your open term plan

18. If you change your mind before you're connected to Mercury Broadband, we will do our best to cancel your Offer before you incur any costs.  If you have accepted this Offer as a result of an uninvited direct sale (where you have not invited us (or our partners) to call you), you can cancel within 5 working days of receiving confirmation of the open term plan you have entered into.  Where you cancel within 5 working days, we will refund you any charges that you may have paid in relation to this Offer.

19.   Otherwise, you can cancel your open term broadband plan at any time by giving us at least 30 days' prior notice, unless we agree to a shorter notice period. You'll be responsible for any charges until your disconnection date. 

Moving

20.   If you want to move property, please contact us at least 10 business days before you move.  You should be able to take your Mercury Broadband open term plan with you so long as your move is to a property that already has Fibre Broadband available and you also take your Mercury residential electricity or Dual Fuel plan with you.  If we are unable to transfer your Mercury Broadband to your new address, your broadband will be disconnected on the future date you select for disconnection.

Energy services

21.   Your current residential electricity or Dual Fuel plan and its terms and conditions continue to apply separately for your energy services, including any applicable early termination fees.
