  1. This fixed price plan offer is available to pre-approved existing Dual Fuel (electricity and gas) or electricity only Mercury customers.
  1. This fixed price plan will apply for a term of 1 year (Fixed Term) from the date on which you accept the offer.
Fixed price plan
  1. Your electricity and gas (if applicable) prices will be fixed at the current rate for the Fixed Term.
  2. Your fixed prices are based on your current meter type.
    1. If your meter type changes, where possible, we will put you on the fixed price plan for your new meter.
    2. If your current meter set up is incorrect, we will place you on the correct pricing plan that matches your meter.
  1. If the change to the meter type or meter set up in clause 4 above means your new price will be higher than your current fixed price and (if applicable) you did not request the change of meter type, we will terminate your fixed price plan and:
    1. move your electricity supply to an open-term plan and Mercury standard rates will apply; and
    2. you will not be charged an early termination fee.

    However, if you wish, you can request to stay on the fixed price plan at the new price.
Account credit
  1. If your offer includes a bonus account credit, this credit will be applied to your account within 55 days of when you accept this offer.
Early termination fee
  1. If you cancel your fixed price plan, or we cancel your fixed price plan for your breach in accordance with the Mercury Residential Terms, before the end of your Fixed Term an early termination fee of $150 (inclusive of GST, if any) will apply. This early termination fee does not apply if:
    1. You cancel within 10 days of your fixed price plan confirmation letter (meaning you will be deemed not to have taken up this offer and our standard rates will apply during that period); or
    2. in the circumstances set out in clauses 5, 8, or 9 of these Terms and Conditions; or
    3. if Mercury makes changes in accordance with the standard residential terms, you do not accept those changes, and we choose to terminate your Agreement with us; or
    4. The Fixed Term has expired, even if your prices have not been changed to the Mercury standard rates.
  1. If you move property during the Fixed Term, please contact us before you move and:
    1. You can take your fixed price plan with you so long as your move is within the same network and your new property has the same meter type; or
    2. If we are unable to transfer your fixed price plan to your new address because the conditions in 8(a) above are not met, you will be transferred to an open-term plan and standard Mercury prices and you will not be charged an early termination fee, as long as you remain a Mercury customer.
Other terms
  1. If you choose to move to a plan that includes solar generation rates for electricity during the Fixed Term, your fixed price plan will automatically be terminated and:
    1. Your electricity supply will be moved to an open-term plan and Mercury standard rates will apply; and
    2. A termination fee will not be applied.
  2. The fixed price plan does not fix the price of GST, or any of the Mercury Service Fees. Any change to the NZ Government GST rate, and Mercury Service Fees within the Fixed Term will apply.
  3. You will revert to standard Mercury prices at the end of the Fixed Term, unless Mercury offers you, and you accept, a new fixed term price plan before the end of the Fixed Term.
  4. Unless we tell you otherwise, you cannot combine this fixed price plan offer with any other Mercury offer or pricing plan.
  5. The offer is not transferable or redeemable for cash.
