Special terms and conditions for customers earning Airpoints DollarsTM through Mercury

 

In partnership with Air New Zealand, Mercury customers can earn Airpoints DollarsTM through Mercury, subject to these Special Terms as defined in the Residential or Business Standard Terms & Conditions between Mercury and the Customer (the Mercury Standard Terms).  These are applicable from 17 October 2016.
1. About these terms
1.1 These Special Terms (the Mercury AirpointsTM Terms) apply to how you may earn Airpoints Dollars with Mercury through your Airpoints or Airpoints for Business membership. These do not vary or limit the terms of your Airpoints membership with Air New Zealand (the Air New Zealand Terms). 
1.2 We may change these Mercury Airpoints Terms at any time by giving you at least 30 days’ notice on our website www.mercury.co.nz.
2. Eligibility and registering to earn Airpoints Dollars with Mercury
2.1 In order to earn Airpoints Dollars with Mercury, you must be a Residential or Business Customer (excluding Collective invoicing, Time of Use, SPOT and Large Commercial Customers), and :
2.1.1 have a current valid Air New Zealand Airpoints membership number, OR if you are a business customer an Airpoints for Business membership number, registered against your active Mercury account;
2.1.2 pay your Mercury bills by the due date for payment. 
2.2 You can only have one Airpoints number registered to any Mercury account at any time. 
2.3 You can request to change the Airpoints number linked to your Mercury account at any time.
3. How to opt out
3.1 If we identify that you have an Airpoints membership, we may register your Airpoints number to your Mercury account and you will automatically earn Airpoints Dollars with Mercury. You can opt out at any time.
4. Earning Airpoints Dollars with Mercury
4.1 From 17 October 2016, once registered you will earn 1 Airpoints Dollar, pro rata, for every $200 (including GST) every time you pay your Mercury bill (excluding any discounts or credits applied to your bill, and any service fees or charges).
4.2 You may also earn additional Airpoints Dollars in special offers or promotions from Mercury, subject to the offer or promotion terms.
4.3 Airpoints Dollars earned with Mercury will show on your Airpoints Account with Air New Zealand within 5 business days after you have paid your Mercury bill.
5. Status Points
5.1 You cannot earn Air New Zealand Status Points through Mercury.
6. Deduction of Airpoints Dollars
6.1 We and Air New Zealand reserve the right to deduct Airpoints Dollars earned with Mercury from your Airpoints Account if the payment on which those Airpoints Dollars was earned is refunded or dishonoured for any reason.
7. Privacy
7.1 By having an Airpoints or Airpoints for Business membership number registered against your Mercury account and/or by earning Airpoints Dollars through Mercury, you authorise us to collect, use and disclose the personal information we have collected from you, including information about your Airpoints or Airpoints for Business membership, in accordance with these Mercury Airpoints Terms and the Mercury Standard Terms. 
7.2 We may also collect personal information about you on an anonymised and limited basis from Air New Zealand or its other Airpoints Partners, including information about your membership of Airpoints or Airpoints for Business, information about where and when you earn Airpoints Dollars with Air New Zealand and other Airpoints Partners.
7.3 We may use your personal information:
7.3.1 to identify whether you are eligible to earn Airpoints Dollars through Mercury and to register your Airpoints or Airpoints for Business membership number against your Mercury account;
7.3.2 to award Airpoints Dollars to you in accordance with these Mercury Airpoints Terms;
7.3.3 to enable us to identify and present you with information and offers relating to products and services that may be of interest to you (including by sending you commercial electronic messages, including by email) and generally to operate and develop our, Air New Zealand’s or Airpoints Partners’ businesses; and
7.3.4 for the purpose of sales and marketing research and business improvement analysis.
7.4 We may disclose the personal information that we collect from or about you to Air New Zealand and its contractors (who may disclose the information to other Airpoints Partners on an anonymised and limited basis):
7.4.1 to award Airpoints Dollars to you in accordance with these Mercury Airpoints Terms;
7.4.2 to enable us and or Air New Zealand to identify and present you with information and offers relating to products and services that may be of interest to you (including by sending you commercial electronic messages, including by email) and generally to operate and develop our, Air New Zealand’s or Airpoints Partners’ businesses;
7.4.3 to be held by Air New Zealand and its contractors which may then be accessed by us and by other Airpoints Partners; and
7.4.4 for the purpose of sales and marketing research and business improvement analysis.
7.5 You have the right to access and request correction of information that we, Air New Zealand or other Airpoints Partners hold about you. To contact Air New Zealand for this purpose, please refer to Air New Zealand’s website. To contact us, please call our Customer Service Representatives on 0800 10 18 10. To contact other Airpoints Partners, please refer to their websites.  
8. Cancellation
8.1 We may stop awarding Airpoints Dollars to you at any time at our absolute discretion, including if:
8.1.1 we give you notice (in accordance with our Mercury Standard Terms) that we cease to be a partner in Air New Zealand’s Airpoints Programme ; or
8.1.2 you cease to be eligible to earn Airpoints Dollars through Mercury in accordance with section 2 above. 
8.2 The termination of these Mercury Airpoints Terms does not terminate the Agreement between us, which shall continue in force in accordance with the Mercury Standard Terms and any other applicable Special Terms.
9. Liability
9.1 We are not responsible and accept no liability for any breach by Air New Zealand or its Airpoints Partners of its obligations to you in respect of the Airpoints Programme.
9.2 Our liability under or in connection with these Mercury Airpoints Terms is limited as described in the Mercury Standard Terms.
