Solar 3 year fixed
The fixed price for energy and buyback rate set out in these terms is only for customers who have entered into an agreement with Mercury for the supply and installation of solar equipment.
The prices set out in these special terms will apply for a period of 3 years from the date on which we install your solar equipment. Until that date:
if you are an existing customer, the prices and terms set out in your existing plan will continue to apply; and
if you are a new customer, our standard terms and prices will apply.
An early termination fee of $150 (inclusive of GST, if any) will apply if you cancel your fixed price plan before the end of your initial term, to compensate Mercury for its losses. This early termination fee does not apply if:
you cancel within 30 days of your fixed price plan confirmation letter in which case your prior rates will apply during that period (if you were an existing customer prior to signing up to these special terms) or our standard rates in all other cases, and you will not be entitled to sell us any electricity at the buyback rate set out in these terms;
your term is a renewal term; or
we change the buyback rate you receive in accordance with clause 8 of these special terms.
If you move property during the fixed period you will revert to standard Mercury prices and you will not be charged an early termination fee, provided you remain a Mercury customer. Please let us know when you’re moving.
Your fixed prices are based on your current meter type and solar configuration.
If your meter type changes, where possible Mercury will put you on the fixed price plan for your new meter or solar configuration.
If your current meter configuration is incorrect, we will put you on the correct pricing plan that matches your meter.
If you no longer have solar equipment installed at your property, you will revert to standard Mercury prices.
The fixed price plan does not include goods and services tax (“GST”), and any of the Mercury Service Fees (as available on our website). Any subsequent change to the NZ Government GST rate, and Mercury Service Fees within the period of this agreement will apply.
Your fixed price plan term (and each subsequent renewal term (if any)), will be automatically renewed for a further term if Mercury sends you written notice of your new fixed prices before the end of the term.
You may choose not to renew your fixed price plan for a further term by giving Mercury notice by email, phone or in writing, opting out of such renewal within the last 30 days of your then-current fixed price plan term.
If, for any reason, Mercury does not notify you of the prices that will apply to a renewal term before the end of the then-current term, your fixed price plan will expire at the end of such term. If your fixed price plan term is not renewed at the end of the then-current term (for any reason) then you will revert to standard Mercury prices at the end of such term.
You may generate electricity from your solar equipment to sell to us provided that we continue to supply your property with electricity. We will pay you for your generated electricity at the buyback rate specified in your pricing plan. If your network company introduces buyback network charges we may change the buyback rate you receive to take account of such change.
GST on your generated electricity:
You must inform Mercury of your GST registration status prior to the first electricity supply you make to Mercury under clause 8 of these special terms. Where you are GST registered pursuant to the Goods and Services Act 1985, you must also provide Mercury with your GST registration number.
You must notify Mercury if your GST registration status subsequently changes.
Where you notify Mercury that you are GST registered:
1. Mercury will issue you with a buyer-created tax invoice (“BCTI”) for each taxable supply made by you pursuant to clause 8 of these special terms and you will not issue a tax invoice for that supply, and
2. Mercury will pay you, in addition to any other amount payable by Mercury pursuant to clause 8 of these special terms, an amount equal to GST shown in the BCTI. This GST will be paid at the same time as we pay you for your generated electricity.
For the term of your fixed price plan, you will be able to access the GEM for Solar at no additional cost. Mercury may suspend or cancel the availability of the GEM for Solar at its discretion. You agree and acknowledge that your personal information may be used by Mercury (and disclosed to, and used by, the third party service providers involved in the operation of the GEM for Solar) to provide you with access to the GEM for Solar.
This offer or pricing plan cannot be combined (in whole or in part) with any other Mercury offer or pricing plan.
