Three Year Fixed PRICE PLAN TERMS

1. This Three Year Fixed rate for electricity is for pre-approved existing Mercury Three Year Fixed customers.
2. An early termination fee of $150 (inclusive of GST) will apply if you cancel your Three Year Fixed price plan for electricity before the end of your three year term
(including any renewal term).
3. If you move property during the Three Year Fixed period:
a. you can take your Three Year Fixed price plan with you so long as your move is within the same network and your new property has the same meter type to
support electricity supply; or
b. if we are unable to transfer your Three Year Fixed rate forward with you, you will revert to standard Mercury rates and you will not be charged an early
termination fee, provided you remain a Mercury customer. Please contact us before you move.
4. Your pre-approved fixed prices are based on your current meter type.
a. If your meter type changes, where possible Mercury will put you on the Three Year Fixed price plan for your new meter.
b. If your current meter configuration is incorrect, we will place you on the correct pricing plan that matches your meter.
5. The Three Year Fixed price plan does not include GST. Any subsequent increase to the New Zealand Government GST rate within the three year term will apply.
6. Your Three Year Fixed price plan term (and each subsequent renewal term (if any)), will be automatically renewed for a further term of three years if Mercury sends
you written notice of your new fixed rates before the end of the term.
a. You may choose not to renew your Three Year Fixed price plan for a further term by giving Mercury written notice opting out of such renewal within 30 days
of your then-current Three Year Fixed price plan term.
b. If, for any reason, Mercury does not notify you of the prices that will apply to a renewal term before the end of the then-current term, your Three Year Fixed
price plan will expire at the end of such term. If your Three Year Fixed price plan term is not renewed at the end of the then-current three year term (for any
reason) then you will revert to standard Mercury rates at the end of such term.

WIN POWER FOR THREE YEARS
1. The winner of the ‘Free Power’ prize draw will receive free power for three years, to the maximum value of $7,500 (including GST), at an annual limit of $2,500
(including GST). The winner will have their monthly bill balance paid by Mercury, until they reach the annual limit each year. If the winner’s power bill is less than
$2,500 (including GST) in a year, we will not be able to offer any cash alternative or carry the credit over.
2. The winner of the ‘Free Power’ prize must remain a customer of Mercury during the three year period, to be eligible for the prize.
3. Entry under this promotion is restricted to the Mercury account holder. Only one entry per household will be accepted.
4. Entry into the prize draw will be automatic upon your acceptance of the Three Year Fixed price plan for electricity.
5. Prize draw entries will close at 5pm on 26 October 2012.
6. The winner will be drawn on 29 October 2012, and notified by 5pm on 31 October 2012.
7. Mercury’s decision in relation to the prize draw (including but not limited to eligibility) shall be final and no correspondence will be entered into.
8. This prize is not redeemable for cash.
9. Mercury reserves the right to use the winner’s name, city or town and photo for publicity purposes associated with the draw.
10. Employees of Mighty River Power and its advertising agencies and their immediate families are not eligible to enter the ‘Free power’ prize competition.
11. Mercury reserves the right to add any additional promotions or amend these terms and conditions in any way up to the date for closing of entries.
